These Terms of Service (the “Terms”) are a binding agreement between you and Amptree LLC (“Amptree,” “we,” “our,” or “us”) and govern your access to and use of the AmpTree website at amptree.io and the AmpTree mobile application (collectively, the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
AmpTree is a social community for music. The Service lets you create an artist or fan profile, share posts and replies, follow other users, exchange direct messages, and purchase merchandise from artist-operated Shopify storefronts with payments processed by Stripe.
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.
You are responsible for activity that occurs under your account and for keeping your credentials secure. You agree to provide accurate information when creating an account and to keep it up to date.
You retain ownership of the posts, replies, profile information, messages, photos, and other content you submit to the Service (your “User Content”). By submitting User Content, you grant Amptree a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content for the purpose of operating and improving the Service. This license ends when you or we delete your User Content, except that messages you have sent to other users may remain visible to those recipients.
You represent that you own or have all necessary rights to the User Content you submit and that it does not violate the rights of any third party or applicable law.
Amptree has zero tolerance for objectionable content or abusive users. You agree that you will not post, send, or otherwise share any content, and you will not engage in any conduct, that is objectionable, including but not limited to content or conduct that is:
Content or conduct that violates these Terms will be removed, and the accounts responsible may be suspended or terminated without prior notice. We aim to act on reports of objectionable content or abusive users within 24 hours of receipt.
You can report objectionable content or abusive users from inside the app by tapping the report option on a post, reply, message, or profile, or by emailing info@amptree.io. You can also block any user from inside the app to prevent them from contacting or interacting with you. For more detail on what is and is not allowed, see our Community Guidelines.
Merchandise on AmpTree is sold by independent artists through Shopify storefronts they operate. Payments are processed by Stripe. When you place an order, your order details and shipping address are shared with Stripe, Shopify, and the artist’s storefront so the artist can fulfill the order.
The artist whose storefront you purchased from is the seller of record. Fulfillment, shipping, returns, refunds, and customer service for the product are the responsibility of that artist and are subject to the storefront’s own policies. Amptree is not a party to the sale and does not warrant or assume liability for the merchandise itself, except as required by law.

We may remove content, restrict features, suspend, or terminate your account at any time if we reasonably believe you have violated these Terms or our Community Guidelines, or to protect the Service or its users.
You may delete your account at any time from inside the app under Settings → Account → Delete account. Sections of these Terms that by their nature should survive will survive termination, including ownership provisions, warranty disclaimers, and limitations of liability.
The AmpTree name, logo, app, website, and all related software, design, and branding are owned by Amptree LLC and are protected by intellectual property laws. Except for the rights expressly granted in these Terms, we reserve all rights in the Service.
If you believe content on the Service infringes your copyright, send a notice including: identification of the copyrighted work, identification of the allegedly infringing material and where it appears on the Service, your contact information, a statement that you have a good-faith belief that the use is not authorized, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your signature. Send notices to info@amptree.io.
The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that User Content shared by others will be accurate or appropriate.
To the fullest extent permitted by law, Amptree LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of one hundred US dollars ($100) or the amount you paid Amptree in the twelve months preceding the claim.
You agree to indemnify and hold Amptree LLC harmless from any claim or demand made by a third party arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We may modify these Terms from time to time. When we make material changes, we will revise the “Last updated” date and, where appropriate, notify you in the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the State of Wisconsin, without regard to its conflict of laws principles. The federal and state courts located in Wisconsin will have exclusive jurisdiction over any dispute arising out of these Terms or the Service, unless applicable law requires otherwise.
